ANY use of EOD.net services must conform to the following Terms Of Service (TOS).

Privacy and Data Logging Policy

All customer and prospect information received by EOD.net in the course of providing email-on-demand, mailing list, form processing or any other service remains solely the property of the service owner. EOD.net will not sell, give away, or utilize such information in any way except as instructed by the account owner. Email addresses are logged in various ways depending on the service, and such usage logs are made available to the account owner or their designate as requested.

EOD.net takes appropriate and reasonable precautions to protect said usage logs and information, but 100% security cannot be guaranteed due to the fundamental technology limitations of email and web services.

Terms of Service

EOD.net's Terms of Service are designed to protect EOD.net, our customers and the Internet community in general from irresponsible and illegal activities.

Payment of any invoices indicates your acceptance of the following terms:

1. Sending unsolicited bulk email (UBE), whether sent from our servers or not, is prohibited. Mail abuse including, but not limited to, mass mailing unsolicited email and email forgery and usenet news abuse including, but not limited to, mass cross posting articles and posting unrelated to group topics, whether direct or indirect, is prohibited.

2. EOD.net will use its best efforts to maintain, but does not guarantee, the privacy of email, mailing lists, and the contents of user accounts. Mailing lists are the property of the owner only and will not be resold or used for any purpose without the owner's permission. "Owner" means the person or entity paying service invoice.

3. Distribution of any copyrighted material without permission of the copyright owner is prohibited.

4. Promotion of pornographic, adult, sexual or illegal material is prohibited. We reserve the right to refuse marginally legal, controversial or other objectionable material.

5. Use of EOD.net services, including the storage of information, is at the account holder's sole risk. EOD.net does not warrant either the results to be obtained from the service or that the service will be uninterrupted or error free. EOD.net's services are provided on an "as is" basis without warranties of any kind, either express or implied. Neither EOD.net nor anyone else involved in creating, producing, or delivering EOD.net services shall be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of EOD.net services, the inability to use EOD.net systems, or any breach of any warranty. The provisions of this paragraph shall survive termination of this agreement.

6. The account holder will indemnify and hold harmless EOD.net against any loss, damage, cost and expense which EOD.net may incur or become liable for by reason of claims or actions for libel, violation of privacy rights, plagiarism, copyright infringement, and claims arising in connection with data transmitted pursuant to the terms and provisions of this agreement and any claims or suits resulting from the account holder's use of the service including, without limitation, the expense and cost of defending any and all such claims and actions, except where such claims result solely from the negligence of EOD.net's failure to perform its obligations under this agreement. The provisions of this paragraph shall survive termination of this agreement.

7. EOD.net reserves the right to reject mail to or passing through a hosted domain or any EOD.net computer from any user, domain, provider, IP address/netblock, or company that engages in, permits, or allows spamming.

8. EOD.net may terminate service to the subscriber at any time, without notice, for violation of this agreement. EOD.net will not be liable for any damages or harm to the account holder resulting from such termination.

9. This agreement shall be governed by and construed in accordance with the laws of Taiwan. This agreement contains the full understanding of the parties with respect to the subject matter hereof. Any email correspondence with the account holder which is in any way inconsistent with, or which adds to, the provisions of this agreement is null and void.
